In March 2020, Jaxon Sales told his parents he was going on a date. At 11pm, they texted to ask if he was coming home that night, and he responded that he was. But Jaxon never came home. His parents weren’t told what happened until months later. Jaxon was found dead and naked on the bed of a 41-year-old he didn’t know, but the police refused to investigate, just saying that “the gay community uses GHB” (a known date rape drug). Our 20-year-old son’s death deserves the same investigation given to any human being, regardless of gender, ethnicity or sexual orientation. Our goal is to have the San Francisco Police Department (SFPD) and SF Office of the Chief Medical Examiner (SF OCME) reopen and thoroughly investigate the circumstances of our son’s sudden death.

On the night of March 1, 2020, our amazing, beloved son Jaxon went to a high-rise apartment in an affluent area of San Francisco for a blind date. We texted him at 11pm to check if he was coming home that night. Jaxon said he would – and he always came home when he said he would. Jaxon never came home from that date.  Every parent’s nightmare became our reality.

We were told to wait for the police and medical examiner’s reports to get any information. Those reports were finally sent to us months later after repeated follow-up.  Only then did we learn that our vibrant, hardworking, gay, Asian American son was found naked and dead in the bed of a 41-year-old white male whom Jaxon did not know. The San Francisco Medical Examiner conducted the autopsy and, without any substantive investigation, declared Jaxon’s death an accidental drug overdose. The drug that killed Jaxon was GHB, Gamma-Hydroxybutyric Acid, also commonly known as the date rape drug.

The Assistant Medical Examiner justified the lack of investigation by saying only, “the gay community uses GHB.” Yet the SFPD report, such as it is, raises only more questions. We believe that the Medical Examiner’s statement that no investigation is needed as “the gay community uses GHB” is discriminatory based on Jaxon’s sexual orientation. We believe that if Jaxon was heterosexual, both the SFPD and the SF OCME would have fully investigated the circumstances of our son’s death.

Over the last several months, we have asked San Francisco Police Department (SFPD) Captain Timothy Falvey and David Serrano-Sewell at the SF Office of the Medical Examiner (SF OCME) to investigate:

  • The 41-year-old white male, in whose bed Jaxon died, stated in the Medical Examiner report that he and Jaxon went to bed at 2am and he heard Jaxon snoring at 6:30am when he got up to shower and clean the apartment. He called 911 and reported Jaxon dead at 7:30am. If Jaxon was given the GHB right before he went to bed, why would an overdose have taken five hours to kill him? What time did Jaxon ingest that lethal dose of GHB? Did Jaxon actually consent to taking this drug? While Jaxon was dying from a GHB overdose, why did that person shower and clean his residence before calling 911?
  • The illegal drugs were found the morning of Jaxon’s death stowed away in a closet.  Why was no one questioned about possessing those drugs?
  • The 41-year-old white male reported other guests at the apartment that night of March 1st, yet SFPD nor the SF OCME questioned anyone else to corroborate the story or clarify inconsistencies in SFPD and SF OCME reports. One report stated that multiple guests were in attendance.  A different report stated, from the same source, that a “mutual acquaintance” brought Jaxon to the apartment.  Why was the person who brought Jaxon to the apartment never questioned?   
  • When Jaxon’s uncle picked up Jaxon’s belongings at the SF OCME on March 3, 2020, the representative at the office told him about another overdose at that male’s apartment only one week prior to Jaxon’s. A recent prior overdose in that apartment raises a huge red flag. Why hasn’t that overdose victim been questioned? 
  • We cannot gain access to the contents of Jaxon’s phone due to the locked passcode. Records show 38 texts between Jaxon and a specific phone number on March 1st. We have identified the owner of that phone number and have given that information to the police, yet they have not investigated it. We reached out to the owner of the phone number, who told us to contact that male and refused to disclose the nature of their relationship.  What is the connection between the owner of that phone number and the 41-year-old white male who was with Jaxon when he died? 

Both SFPD Captain Timothy Falvey and David Serrano-Sewell have refused multiple requests to investigate these concerns. 

We’ve spent the last two years devastated, paralyzed, and grieving Jaxon’s death and repeatedly asking for answers to our unanswered questions. We want the truth to what happened to Jaxon that night and to understand why he never came home.

Again, we believe the SF OCME’s verbal statement that no further investigation is needed as “the gay community uses GHB” is discriminatory based on Jaxon’s sexual orientation. We also believe that if Jaxon was heterosexual, the SFPD and SF OCME would have fully and thoroughly investigated the circumstances of his death.

We are seeking your help to demand that these agencies reopen Jaxon’s case and investigate what happened to him the night he died. Please help us by doing the following:
