Black Baccara is a small, woman owned, lgbtq+ owned, minority owned business. The company’s founder, Kalliope Amorphous, has offered her artisan perfumes and other unique handmade items under the name Black Baccara for more than 10 years to collectors of her art. A lifelong advocate for artists rights and the intellectual property rights of artists, she recently applied for a federal trademark on her small business name. A federal trademark would block others from copying her designs (which has happened frequently in the past) and protect the livelihood and brand that she has worked so hard to build. But Baccarat, a multi-million luxury crystal company, has sent her a cease and desist letter, stating that not only do they intend to block Amorphous from protecting her small business, but they intend on shutting it down. The Corporate Goliath has threatened to block Black Baccara’s trademark attempt and has threatened to shut her small business down. Baccarat alleges that Black Baccara confuses Baccarat customers and dilutes its multi-million dollar brand name and image. In their cease and desist letter, Baccarat has demanded that Kalliope immediately shut down her website, abandon her domain name, withdraw her trademark application, and change her company name by November 10th. This would mean the immediate death of a small business that has been operating since 2010. This is a clear case of corporate bullying, and we won’t tolerate it. Kalliope is a small business owner and individual artist -she is no threat to a multi-million dollar luxury crystal brand. She has a right to pursue her livelihood as an artist. Nobody is confusing the work of this individual artist with a multimillion dollar luxury brand. Black Baccara is a small business that has been operating for over a decade and prides itself on being a handmade alternative to big box companies. Sign this petition demanding that Baccarat stop blocking Black Baccara’s federal trademark and withdraw their requests to shut down Kalliope’s small business during the holiday season. It’s time we take a stand against bullying from corporations against artists and small businesses. | ||
