Lymond Moses was murdered by New Castle County Police Department officers on January 13th, 2021 in Wilmington, DE. He was approached by the officers as he was asleep in his parked and legally rented vehicle. BWC footage show officer #1 used a baton to break the plane of his car, without consent, to turn his engine off. This woke Lymond up. The officers began exclaiming that they were conducting an investigation into stolen cars. Lymond explained to them that his car was not stolen and his mom lives in the neighborhood. The officers then proceeded to open up both of his car doors, again, without consent. Next the officer on the passenger side is seen searching the vehicle with his flashlight, without consent; he discovered a decriminalized amount of weed that is legally allowed to be possesed and used personally according to Senate Bill 45. The very act of NCCPD being in the area, outside of their jurisdiction, was a breaching of the jurisdictional policy as they did not notify the Wilmington Police Department that they were conducting said investigation. After being threatened to be dragged and pulled out of his vehicle; Lymond attempted to evade the officers. He reached a dead end where he did a U-turn and is seen steering his vehicle away from the officers who followed him up to the dead end. Just as he was pulling off officer #1 shot directly into the driver’s side window. Which family and attorney believe to be the fatal shot to the head according to death certificate. The rounds continue from the first and second officer on the scene. The third officer did not shoot. Before the body worn camera footage was released, after a string of protests from the family and community activists, the police department representative Chief Vaughn Bond released a statement that Lymond "drove directly at officers at a high-rate of speed". This account has aided in a effort to blame Lymond for his own death. The body worn camera footage refuted that false narrative. The chief has since admitted that the statement was released before he watched the bwc footage, after apologizing to the family for doing so. He has also admitted that the officers involved had no jurisdiction in the area. The release of the video was another act of violence and trying to justify and victim blame. The representative from the police department, Brian Faulkner, fed the public a false narration of the events including: stating that the vehicle was in drive, and listing Lymond’s past criminal records and the report of the drug test that they conducted after Lymond was already deceased. We are calling for the indictment of the officers involved for the murder of Lymond Moses. The attorney General as well as the chief told the family that criminal charges had been brought against officers on two occasions. Once around January or February during the families private showing of the bwc footage and on or about April 29th during a meeting at the AG’s office. However, in a conversation with the family on 7/29/2021 with previous lead investigator on the case, Deputy Attorney General Mark A. Denney, the decision to charge had not been made yet. It was said that the Attorney General was on vacation until August 9th, 2021 abd the decision to charge or release a report that the officers were justified would be made then. The DAG has since been recused from the case after he made remarks that seemingly attempted to justify the officers. When questioned from the family about what probable cause the officers had to approach Lymond’s vehicle, he responded that Lymond "was slumped over the steering wheel". Which is a lie, evidenced by the BWC footage. This sparked a string of protests at the home of the DAG, 7 months into the investigation. Now the AG’s office is using the protests as an excuse for why the investigation is not completed. Please sign this petition requesting that Attorney General Kathleen Jennings does her job and criminally charges the murderous officers.
